Accepting these terms
These terms cover your use of the Formcraft Medford Concrete Construction website and any estimate or work you get from us. By using this site, asking for a quote or hiring our crew, you agree to these terms.
If you don't agree with them, please don't use the site. You can still call us at (781) 628-7780 to talk before you decide anything.
When a written estimate or contract signed by you and by us says something different from this page, the signed document controls for that job.
What we do
Formcraft Medford Concrete Construction is a concrete contractor in Medford, MA. We build driveways, patios, sidewalks, steps, garage floors, foundations, footings, retaining walls and other flatwork, which covers the flat slabs people walk, park and sit on, for homes and businesses in Medford and the cities around it.
The services on our home page and our service pages describe the kind of work we do in general. They aren't an offer to do a particular job at a particular price. You can read more about how we work on our About page.
We're licensed and insured. The exact scope of your job, including materials, thickness, finish and what's included in site prep, is set in your written estimate or contract and nowhere else.
Estimates and pricing
We give free quotes on site, with no pressure and no obligation, because we can't price concrete work well without seeing the ground, the slope, the access and what has to come out first.
An estimate is based on what we can see and measure on the day we visit. If we find something once the job is open that nobody could see beforehand, such as buried debris, soft or wet subgrade, which is the ground the slab sits on, old footings or ledge, we'll stop, show you and agree a change with you before we do the extra work.
Prices on an estimate hold for the period written on it. After that, material and labor costs can change, so we may need to update the figure before scheduling. Nothing on this website is a quote for your job.
Scheduling, weather and cancellation
We schedule pours around the weather because concrete placed in rain, freezing temperatures or extreme heat can end up weak or flaky on top. If the forecast or site conditions aren't right, we'll move your date, and that isn't a breach of our agreement.
Start and finish dates are our best estimate, not a promise. Delays can come from weather, material supply, permit or inspection timing, or conditions we find on site, and we'll keep you posted when a date moves.
If you need to cancel or reschedule, please tell us as early as you can by phone or through our contact page. If we've already ordered materials, set forms or done prep work, you may owe for that work and those materials as your written agreement describes.
Payment
Your written estimate or contract sets the amount due, when it's due and how you can pay. Some jobs call for a deposit before we order materials or book a pour date, and the agreement will say so if yours does.
Payment is due on the terms you agreed to. If a balance goes unpaid, we may pause work, charge any late fees the agreement allows and use the remedies Massachusetts law gives contractors.
Any change to the scope of the job, whether you ask for it or a hidden condition calls for it, is added in writing before we do it, so the final bill doesn't surprise you.
Your part of the job
We ask you to give our crew clear access to the work area, tell us what you know about buried lines, drains, septic parts or sprinkler pipes, and keep people, pets and vehicles off the area while we work.
New concrete needs time to cure, which is the waiting period while it hardens and gains strength before it can take weight. We'll tell you when it's safe to walk and drive on it, and damage from using it too early, or from road salt or chemicals against our care instructions, isn't covered.
Warranties and what concrete does on its own
We stand behind our work, and our satisfaction guarantee applies as described in your written agreement. Any written warranty for your job is the one in that agreement, and it's the only warranty we give.
Concrete shrinks as it cures, and that's why we cut control joints, which are planned grooves that give the slab a place to crack out of sight. Small hairline cracks, slight color differences between pours and small surface changes are normal for concrete and aren't defects.
We don't warrant against damage from frost heave in soil we didn't prepare, tree roots, ground movement, flooding, heavy vehicles beyond what the slab was built for, or work done by others after us. Apart from what's written in your agreement, and to the extent the law allows, we make no other warranties, express or implied.
Limits on our liability
To the extent Massachusetts law allows, Formcraft Medford Concrete Construction isn't liable for indirect, incidental or consequential losses, such as lost use of a driveway, lost income or damage that results from conditions we didn't create and couldn't reasonably see.
Our total liability for any claim about a job is limited to the amount you paid us for that job. Nothing on this page limits any right you have that the law doesn't allow a contractor to limit.
Using this website
The information on this site is general and is here to help you understand concrete work before you call. It isn't professional advice for your property, and we may update or correct it at any time.
The text, photos and design on this site belong to Formcraft Medford Concrete Construction or are used with permission. Please don't copy them for commercial use without asking us first.
If we link to another website, such as a city office, we do it as a courtesy. We don't control those sites and aren't responsible for what they say.
Settling disagreements
If you're unhappy with any part of our work or billing, call us first at (781) 628-7780 or write to us through our contact page. Most problems get settled by walking the job together, and we'd like the chance to make it right before anything else.
If we can't settle it that way, either of us may take the matter to a court with jurisdiction in Middlesex County, Massachusetts, or use mediation if we both agree to it.
Governing law
These terms and any work we do for you are governed by the laws of the Commonwealth of Massachusetts, without regard to the rules on conflicts of law.
Changes to these terms
We may update these terms from time to time, and the version posted on this page is the one in effect. A change won't alter the terms of a written agreement you've already signed with us.
If you keep using the site after we post a change, you accept the updated terms.
Questions about these terms
If anything here isn't clear, call us at (781) 628-7780 or send a note through our contact page, and we'll explain it in plain terms before you commit to anything.
